PRIVACY STATEMENT FOR JOB APPLICANTS

This Privacy Statement is published by Newell Brands Inc on behalf of itself and any of its affiliates acting as a "controller" under relevant data protection rules and regulations, collectively "Newell Brands". By submitting your application or your CV, you acknowledge having read and understood this Privacy Statement. If you do not wish your information to be used as follows, please do not submit your application or your CV.

This Privacy Statement sets out:
  • which personal data we gather in the course of the application and recruiting process;
  • how we use your personal data;
  • who has access to your personal data;
  • whether we transfer of your personal data to third countries;
  • how long we keep your personal data;
  • how you can access and modify the personal data we collect about you;
  • how we secure your personal data;
  • how you can submit questions and remarks.

Which personal data do we collect?

This Privacy Statement relates to all personal data that we receive from you and that we collect and process about you (i) in the context of your application and the resulting recruitment process or (ii) for inclusion in our database.

These personal data can include: identification and contact details, personal characteristics (such as gender and date of birth), education and work experience (including results, certificates, degrees, references), job preferences, interests, hobbies, video material, audio material, financial data (e.g. current and desired salary), all data in your CV and cover letter, all publicly available data on public websites, and all other personal data you have provided to us orally or in writing in the context of your application.

How do we use your personal data?

Your personal data will be used in the context of your application and recruitment process, including for:
  1. evaluating your skills, qualifications and interests against our career opportunities;
  2. checking your data, your references and/or conducting background checks (where applicable);
  3. communication concerning the recruitment process and your application; and
  4. implementing improvements to the application and recruitment process within Newell Brands.
The processing for the purposes 1, 2 and 3 described above are necessary for the potential conclusion of an agreement between you and Newell Brands and the processing for purpose 4 is based on the legitimate interest of Newell Brands to improve its processes on the basis of your application and recruitment procedure.

Who has access to your personal data?

Your personal data is collected by or on behalf of the Controller. Within this entity only certain members of the HR department and managers have access to your personal data. In certain cases, technical staff members may also have access to your personal data, but only insofar as is necessary to ensure the proper functioning of our technical systems.

Newell Brands may make use of external service providers or third parties for any of the purposes described above (e.g. recruitment websites, agencies conducting background checks or talent management system providers). These processors instructed by us may also include companies within the Newell Brands group that provide services on our behalf (e.g. IT services). In such cases, access to your personal data will be limited to the purposes described in this Privacy Statement, and in accordance with the requirements of the applicable data protection legislation.

We also share your data with the following recipients, which act as independent controllers:
  • Newell Europe Sàrl, Chemin de Blandonnet 10 Vernier, 1214 Switzerland, and Newell Poland Services SP. Z O.O. Plac Andersa 7 Poznan, 61-894 Poland (both Newell Brands Group companies) in the context of centralized recruitment services. Within these two entities only specific staff members within the HR department have access to your personal data as well as technical staff members as far as this is necessary to ensure the proper functioning of their technical systems.
  • External consultants (e.g. lawyers and accountants);
  • Authorities;
  • Courts; and
  • Others as far as we are obliged to transfer your data or we received your respective consent.

Transfer of your personal data to third countries

We may transfer your data to third countries (countries outside the European Economic Area), for instance to our affiliate Newell Europe Sàrl located in Switzerland. Please note that the European Commission has affirmed an adequate level of data protection for Switzerland.

In the event of transfer of your personal data to a country outside of the European Economic Area, Newell Brands systematically ensures the application of an adequate level of protection of such personal data by approved means (e.g. selecting “Privacy Shield”-certified processors or putting in place standard contractual clauses on the processing of personal data, in accordance with the EU Commission model clauses). You can request more information about such measures (including copies where relevant) by contacting the Controller using the contact details below.

How long do we retain your personal data?

The retention period of your personal data depends on the outcome of the application process.

If your application is successful, your personal data obtained in the context of the application and recruitment procedure will be included in your personnel file. You will then be informed separately of how Newell Brands processes personal data of employees.

If your application is unsuccessful, we will delete your personal data no later than 4 weeks after we have informed you about the rejection of your application. Until such deletion, we will restrict the use of this data to the purpose of litigation management. In the event of any legal dispute, we will be obliged to store your personal data for the duration of the legal proceedings and afterwards in accordance with statutory retention periods up to 10 years or such shorter or longer period as is prescribed by local law.

If you consent to your data being stored for a longer period so that we may contact you in relation to future suitable vacancies, we will store your personal data until we receive notice of your withdrawal of your consent or, in any case, for the maximum period of 1 year. If you would not like to be considered further for other positions, please let the relevant HR recruitment officer know.

Accessing and correcting your personal data

You have a legal right to access your personal data, to have them corrected, to have them erased, or to receive them in a structured, commonly used and machine-readable format that can be transferred to another party.

Right to object: You have the right to object to the processing of your personal data on the basis of compelling grounds relating to your particular situation where the processing is performed on the basis of our legitimate interests. In the event of your objection we will stop processing your personal data unless we can demonstrate compelling legitimate grounds overriding your interests or the processing of your personal data is necessary for the establishment, exercise or defence of legal claims.

You also have a right to (i) withdraw consent for the processing of your personal data, where applicable, and (ii) file a complaint with the competent supervisory authority of the country in which you reside, details of which can be provided on request by the Data Privacy Committee at Consulta de privacidad de datos or the lead supervisory authority for Newell Brands, namely The Information Commissioner’s Office of Wycliff House, Water Lane, Wilmslow, Cheshire SK9 6AF, United Kingdom, www.ico.co.uk

If you wish to exercise any of these rights, please submit your request (i) using our Subject Access Request or (ii) to your relevant HR recruitment officer.

You remain responsible for any personal data you provide and for the consequences of such action. Please note that you may not provide Newell Brands with personal data in breach of obligations towards others relating to privacy, confidentiality, intellectual property or trade secrets, unless you have obtained explicit consent of the relevant person or entity to share these data with Newell Brands for the purposes described in this Privacy Statement. By including references, you guarantee that you have informed the parties involved about the processing of their personal data as described in this Privacy Statement.

Security of your personal data

Our IT systems are secured against unauthorised access. Only competent staff members have access to your personal data, on the basis of a personal login or other means of authentication, and only where this is relevant for the performance of their tasks.

We have implemented appropriate technical, physical and organisational measures to protect your personal data against unlawful or accidental destruction, loss, alteration, unauthorised disclosure and against abuse, damage and theft.
